AGREEMENT ON THE PROCESSING OF PERSONAL DATA AND PRIVACY POLICY

LLC “PR GROUP” represented by Director Balazh Vitaliy Antonovych, acting on the basis of the Charter, EDRPOU code 39939602 (hereinafter referred to as the «Owner»), and the User of this Site (hereinafter also referred to as the «User»), who has accepted and agrees with the terms of this «Agreement on the processing of personal data and privacy policy» (hereinafter referred to as the Agreement), by joining the User to the terms of this Agreement, in the manner provided for by this Agreement, the terms of which provide for the following:

I. GENERAL PROVISIONS

This Agreement has been developed in accordance with the requirements of the Law of Ukraine "On Personal Data Protection" and other regulatory acts of Ukrainian legislation regulating legal relations related to the collection, processing, storage of personal data, as well as the right of citizens to non-interference in their private life and the right to self-expression. This Agreement is a public agreement of accession.
1. The User of the Site https://prgroup.ua/ when visiting the resources of this site confirms his agreement with the rules and requirements of the Agreement. If the User of the Site does not agree with the terms of the Agreement, he is obliged to leave the Site and refrain from visiting it in the future.
2. The User of the Site https://prgroup.ua/ has no right to use the site if he does not agree with the Privacy Policy or if he has not reached the age established by law when he has the right to conclude contracts, or is limited in his rights in accordance with the law.
3. The Site User's personal data will be stored by the Site Owner. https://prgroup.ua/
4. Website https://prgroup.ua/ carries out activities to collect personal data of users who are interested in or intend to purchase the Goods presented on the Site, and respects the privacy of each user, assuming obligations to protect the personal data of users, any information that can be used to confirm the identity and identify a specific person (individual or business entity) representing the interests of such entity. Scope of application of this Site Agreement covers any personal data that the resource processes in accordance with applicable privacy and information laws.
5. The Privacy Policy of the Site https://prgroup.ua/ applies to any type of use of this resource, regardless of whether these actions are performed via a personal computer, mobile version of the Site or mobile application.
6. Website https://prgroup.ua/ does not collect any information for the processing of which certain requirements are established by law, such as information about racial or ethnic origin, political, religious or ideological beliefs, membership in political parties and trade unions, criminal convictions for committing a crime or convictions for criminal punishment, as well as data concerning health, sex life, biometric or genetic data (in accordance with Article 7 of the Law of Ukraine "On Personal Data Protection").

II. TERMS

2.1. For the purposes of this Agreement, the following terms shall have the following meanings:

2.1.1. Personal data – any information or set of information about an individual who is identified or can be specifically identified. The purpose of collecting and processing personal data in the System is to store and maintain data of users who intend to purchase or purchase goods, in accordance with Articles 6, 7 of the Law of Ukraine «On Personal Data Protection» and to ensure the implementation of civil legal relations, provision/receipt and payment for purchased goods, in accordance with the Tax Code of Ukraine, the Law of Ukraine «On Accounting and Financial Reporting in Ukraine».

2.1.2. Owner of the personal data base – LLC “PR GROUP” represented by Director Balazh Vitaliy Antonovych, acting on the basis of the Charter, EDRPOU code 39939602, which, with the consent of the subject of personal data, is on the Website https://prgroup.ua/, granted the right to process this data, which approves the purpose of processing personal data in this database, establishes the composition of this data and the procedure for processing it, unless otherwise specified by law.

2.1.3. Website – a collection of data, electronic (digital) information, other objects of copyright and (or) related rights, etc., interconnected and structured within the address: https://prgroup.ua/ and all its subdomains.

2.1.4. Website https://prgroup.ua/ – acts as an online resource (trading platform) and positions itself as a "Site" for familiarizing yourself with goods and transmitting information to the Owners of the goods for the subsequent conclusion of a public offer agreement for their purchase.

2.1.5. Information Protection Administrator – the access subject responsible for ensuring the protection of the automated system from unauthorized access to information.

2.1.6. Processing of personal data – any action or set of actions to collect, register, accumulate, store, adapt, change, update, use and distribute (distribution, sale, transfer), depersonalize, destroy personal data, including using information databases.

2.1.7. Cookies files — is a text file or files containing a small amount of information that is sent to a web browser and stored on a user's device. Such devices may include a computer, mobile phone or other device through which the user visits the Site.

2.1.8. User – any legally capable person who, by his own free will, has fully accepted (accepted) all the terms and conditions of this Agreement without exception for the purpose of reviewing and expressing his intention to purchase the goods presented on the Website https://prgroup.ua/.

2.2. For the purposes of this Agreement, all terms specified in Section II are used exclusively in the meaning specified in Section II of this Privacy Policy, regardless of the use of these terms in the singular or plural, or in other grammatical forms, cases and/or constructions.

2.3. All other terms not separately defined in this Agreement shall be understood and interpreted in their literal grammatical meaning, based on the provisions of the current legislation of Ukraine, business customs, as well as the purpose and subject matter of this Agreement.

III. PURPOSE OF COLLECTING AND PROCESSING PERSONAL DATA

3.1. Purpose of using personal data:

3.1.1. Your personal data is used for transfer to third parties - Owners of goods posted on the Site https://prgroup.ua/ for the purpose of further concluding a public offer agreement for the sale of goods, as well as for the purpose of ensuring the provision of Internet services of the Site https://prgroup.ua/ for the exchange of information/news, relations in the field of advertising and communication in accordance with the requirements and in compliance with the laws of Ukraine, including, but not limited to: "On the Protection of Personal Data", "On the Ratification of the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data and the Additional Protocol to the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data with regard to Supervisory Authorities and Transborder Data Flows", "On Information", "On Advertising", "On Telecommunications", "On the Protection of Information in Information and Telecommunications Systems", "On State Support for the Mass Media and Social Protection of Journalists", as well as in accordance with the Rules for Using the Site.

3.2. Personal data retention period:

3.2.1. Personal data is stored for no longer than is necessary to achieve the purpose of their processing.

3.3.1. Personal data of Users is processed, among others, in the following areas:

– for transfer to third parties-owners of goods posted on the Site https://prgroup.ua/ for further conclusion of contracts with the User of a public offer for the sale of goods – the basis for data processing in this case will be the contract concluded with the Owner of the Site https://prgroup.ua/

– if the User has consented to this, commercial information regarding goods offered for sale, including promotions, may be sent to the User's specified email address or phone number – in this case, the basis for processing the User's data is his consent, which is not mandatory and can be withdrawn at any time;

– to send the User individual marketing messages, for example, in the form of product offers;

– for marketing purposes – the Owner will periodically send information about the Seller's offers to the correspondence address specified by the User;

– for statistical purposes for the Owner's internal needs – in this case, the basis for data processing will be the Administrator's legally justified interest in collecting information that allows developing activities and tailoring services to the needs of Users.

3.3.2. Website https://prgroup.ua/ reserves the right to provide the User's personal data to entities that may cooperate in the performance of the Public Offer Agreement for the sale of goods concluded by the User, including, in particular, in making payments for the purchased Goods and organizing their delivery.

3.3.3. Under the outlined conditions, the User has the following rights in connection with the processing of his personal data by the Owner of the Site https://prgroup.ua/: the right to access data, update it, the right to request data transfer, deletion, objection to data processing and the right to request restriction of their processing.

3.3.4. The User has the right to submit to the Site https://prgroup.ua/ objection to the processing of the User's personal data directly by the Owner.

3.4. Use of cookies:

3.4.1.Cookies can be permanent (they are called persistent cookies) and are stored on the computer until the user deletes them, or temporary (such cookies are called session cookies), that is, they are stored only until the browser is closed. In addition, cookies are divided into primary (they are installed directly by the visited Site) and third-party (installed by other sites).

3.5. Purposes of using cookies:

Website https://prgroup.ua/ uses an innovative approach to implementing processes necessary to ensure full functionality of the Site and adapt the content of the Site and auxiliary services to the User's preferences and likings, as well as optimize the use of the Site Service. In particular, these files allow recognizing the basic parameters of the User's Device and accordingly displaying the Site, adapted to his individual needs;

– ensuring proper maintenance of the affiliate program, including permission to check the sources of referrals of Users on the Site.

3.6. Security:

3.6.1. Website https://prgroup.ua/ is not intended for minors. The Site Owner is responsible for security issues, especially regarding persons who have not reached the age of majority, in connection with which, for our part, we appeal to parents to explain to their children the issues of security on the Internet, their specific purpose and the need to use certain services of the site.

3.6.2. Website https://prgroup.ua/ takes the necessary organizational and technical measures to protect the User's personal information from unauthorized or accidental access, destruction, distortion, blocking, copying, distribution, as well as from other illegal actions of third parties.

3.6.3. This Agreement applies to the Website https://prgroup.ua/. If, following the links posted on the latter's website, the User accesses third-party resources, the Website https://prgroup.ua/ is not responsible for his actions.

3.6.4. The User's personal data may be used for legal purposes in court or at stages leading to a possible appeal to court due to the fact that the Site or services were used improperly.

3.6.5 The User is aware that the Site Owner may be forced to provide personal data at the request of state authorities in accordance with the procedure provided for by the legislation of Ukraine.

3.7. Interaction of the Site https://prgroup.ua/ with third parties regarding personal data:

3.7.1. Website https://prgroup.ua/ transfers personal data exclusively to third parties - owners of goods posted on the Site https://prgroup.ua/, in other cases the Site https://prgroup.ua/ does not transfer personal data, except in cases where such transfer is required by law, at the request of the subject of personal data or in other cases set out in this Agreement. Personal information is valuable and inalienable content, including personal non-property rights of any individual, and therefore takes all possible measures to protect the personal information of users, voluntarily and knowingly transferred by the latter to the Owner of the personal data base LLC “PR GROUP”.

3.8. Confidentiality of the activity of the personal data subject on the Site https://prgroup.ua/:

3.8.1. Information about the activity (traffic) of Users that passes through the network or the User's e-mail is protected in accordance with the law. That is, in no way or manner do we violate the secrecy of the User's "Activity" when using the latest services of the Site https://prgroup.ua/.

3.8.2. Website https://prgroup.ua/ uses generally accepted standards of technological and operational protection of information and personal data from loss, misuse, alteration or destruction. However, despite all efforts, the Administrator cannot guarantee absolute protection from any threats arising outside the control of the web resource.

3.8.2. Website https://prgroup.ua/ ensures the application of all relevant confidentiality obligations, as well as technical and organizational security measures to prevent unauthorized or unlawful disclosure or processing of such information and data, their accidental loss, destruction or damage.

3.8.3. Website https://prgroup.ua/ provides access to information and personal data only to authorized employees who have agreed to ensure the confidentiality of such information and data.

3.8.4. Dissemination of personal data without the consent of the personal data subject or a person authorized by him is permitted in cases specified by law, and only (if necessary) in the interests of national security, economic well-being and human rights.

3.9. Conditions for access to personal data:

3.9.1. Procedure for access to personal data of third-party owners of goods posted on the Site https://prgroup.ua/ is determined by the terms of this Agreement and the user's consent provided to the owner of personal data for the processing of this data, or in accordance with the requirements of the law.

3.9.2. The User has the right to receive any information about himself from any subject of relations related to personal data, provided that the surname, first name and patronymic, place of residence (place of stay) and details of the document certifying the individual submitting the request are indicated, except for cases established by law.

3.9.3. The user's access to personal data is free of charge.

3.9.4. Delaying a user's access to their personal data is not allowed.

3.9.5. Postponement of access to personal data of third parties is allowed if the necessary data cannot be provided within thirty calendar days from the date of receipt of the request. In this case, the total period for resolving the issues raised in the request cannot exceed forty-five calendar days.

3.9.6. The notice of postponement shall be communicated to the third party who submitted the request in writing, with an explanation of the procedure for appealing such a decision.

3.9.7. The decision to postpone or deny access to personal data may be appealed to the Commissioner for Human Rights of the Verkhovna Rada of Ukraine or through the court.

3.10. Rights of the personal data subject:

3.10.1. Website https://prgroup.ua/ brings to your attention information about your rights as a personal data subject, which are regulated by the Law of Ukraine "On Personal Data Protection", namely:

– to know about the sources of collection, location of their personal data, purpose of their processing, location or place of residence (stay) of the owner or manager of personal data or to provide an appropriate instruction to obtain this information to persons authorized by him, except in cases established by law;

– receive information about the conditions for providing access to personal data, in particular, information about third parties to whom personal data is transferred;

– to access your personal data;

– receive no later than thirty calendar days from the date of receipt of the request, except in cases provided for by law, a response on whether personal data are being processed, as well as receive the content of such personal data;

– submit a reasoned request to the owner of personal data objecting to the processing of their personal data;

– to submit a reasoned request for the modification or destruction of their personal data by any owner and controller of personal data if these data are processed unlawfully or are inaccurate;

– to protect their personal data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision, as well as to protect against the provision of information that is unreliable or defames the honor, dignity and business reputation of an individual;

– file complaints about the processing of their personal data with the Commissioner for Human Rights of the Verkhovna Rada of Ukraine or to the court;

– apply legal remedies in case of violation of personal data protection legislation;

– make reservations regarding the restriction of the right to process their personal data when providing consent;

– withdraw consent to the processing of personal data;

– know the mechanism of automatic processing of personal data;

– to protect against automated decision-making that has legal consequences.

3.11. To update, access, change, block or delete your personal data, withdraw consent to the processing of personal data that you have provided to the Site https://prgroup.ua/ in accordance with this Agreement, or if you have any comments, wishes or claims regarding your personal data that is being processed, send a message to the e-mail address indicated on the Website https://prgroup.ua/, indicating your name, phone number, email and text request.

3.12. Policy Change:

3.12.1. Website https://prgroup.ua/ reserves the right to change this Policy without prior notice to the User; amendments and additions may be made to this Policy, including when changing legislative requirements.

3.12.2. In the event of significant changes to this Policy, a notice will be posted on the Site and the date of entry into force of these changes will be indicated. If the user does not refuse to accept them in writing within the specified period, this will mean that the user agrees with the relevant changes to the Policy. The user undertakes to periodically review the Policy in order to familiarize himself with any changes or additions.

IV. OBLIGATIONS OF THE PARTIES

4.1. ResponsibilitiesOwner Csay:

4.1.1. Use the information received exclusively for the purposes specified in Section 3 of this Agreement.

4.1.2. Ensure that confidential information is kept secret, except for cases provided for by this Agreement and the legislation of Ukraine.

4.1.3. Take all measures to protect the confidentiality of the User's personal data in accordance with the procedure usually used to protect this type of information in business transactions.

4.1.4. Block personal data relating to the relevant User from the moment of the User's request or request, or his legal representative or authorized body for the protection of the rights of personal data subjects for the period of verification, in case of detection of false personal data or illegal actions.

4.2. User Responsibilities:

4.2.1. When using the Site, provide all necessary information regarding personal data for using the Site.

4.2.2. Update and supplement the provided information regarding personal data in the event of its change.

4.2.3. If you do not agree with these terms of this Agreement, stop using the Site.

V. DISPUTE RESOLUTION

5.1. The mandatory first stage of dispute resolution is the submission of a claim (a written proposal by the Party regarding the voluntary settlement of the dispute).

5.2. The recipient of the claim must notify the Applicant in writing of the results of the claim review within 30 calendar days from the date of receipt of the claim.

5.3. In the event of failure to reach an agreement to resolve the dispute through negotiations and filing of claims, the dispute will be referred for consideration to a judicial body in accordance with the current legislation of Ukraine.

VI. CHANGES TO THE PRIVACY POLICY

6.1. Without the consent and prior notice of the User, the Site Owner has the right to make changes to this Agreement.

6.2. The new version of the Privacy Policy comes into force from the moment of its posting on the Site, unless otherwise provided in the new version of the Agreement/Privacy Policy.

6.3. In the event that any clause/part of this Privacy Policy is declared invalid or unenforceable, the remaining clauses/parts thereof will remain in effect.

VII. CONSENT TO THE PROCESSING OF PERSONAL DATA

I, as a subject of personal data, give my voluntary consent to the processing of my personal data provided by me when using the Site https://prgroup.ua/, dwhose activity is carried out by LLC “PR GROUP” represented by the director Balazh Vitaliy Antonovych, acting on the basis of the Charter, EDRPOU code 39939602, in the personal data base of the Site https://prgroup.ua/ in order to ensure the fulfillment by the Owner of the personal data base of its obligations under this Agreement, to ensure relations in the field of purchase and sale of goods, advertising and conducting business relations, sending (sending) to my address special offers, information about new goods and promotional campaigns, discounts and other actions within the scope of its activities, as well as the fulfillment by the Owner of the personal data base of its obligations to me as the Customer of the goods, etc., namely:

– surname, first name, patronymic, residential address, mobile phone number, other contact information, passport data, TIN (RNOKPP), date of birth, place of registration and other information provided by me;

– any other personal data and information voluntarily provided by the Subject of personal data to the Owner of the personal data base, contained in documents provided when filling out questionnaires, conducting surveys, in the process of placing orders, other documents and performing concluded contracts, as well as data that may be necessary for the Owner of the personal data base in connection with the implementation of the purpose of processing personal data, including passport data, if any were provided.

Personal data may be processed by “PR GROUP” LLC represented by Director Balazh Vitaliy Antonovych, acting on the basis of the Charter, EDRPOU code 39939602, and authorized employees of “PR GROUP” LLC.

I agree that PR GROUP LLC, represented by Director Balazh Vitaliy Antonovych, acting on the basis of the Charter, EDRPOU code 39939602, may transfer my personal data to third parties - owners of goods posted on the Site https://prgroup.ua/, affiliated legal entities and individual entrepreneurs in accordance with the purpose of their processing, banking institutions, financial institutions, other third parties, provided that such persons comply with the requirements of the current legislation of Ukraine regarding the protection of personal data (without additional consent and notification of the Subject of personal data in the event of their transfer).

I confirm my agreement with all of the above, and also that I have been informed by the Site Owner about the purpose of processing personal data; the composition and content of personal data; the persons to whom personal data may be transferred; I understand my rights provided for by the Law of Ukraine "On Personal Data Protection", and I also undertake to comply with the rules for using the Site.

I am aware that the Owner of the personal data base reserves the right to change the Rules of Use of the Site https://prgroup.ua/, as well as this Agreement/Privacy Policy at its discretion.
